All you damn defense attorneys talking about contract law. (jk) You obviously have not dealt with WV juries. They are great!

Let me repeat it will be heard by a WV jury. His defense is that WV didn't live upo there end of the bargain. (facilities etc)That is a factual issue. As you know factual issues must be decided by juries. WV didn't want this heard in Michigan or in Federal Court so they struck first to have home field advantage.

Game, set match. He will now pay up or damn well close to it.

I doubt if the venue is decided based on who filed first. Contracts typically state the jurisdication whose laws govern the contract.
