Timeshare problem… yeah I know

My father passed away last year. He was an absolute moron when it came to financial stuff and was the epitome of a “sucker” and got into a timeshare agreement.
My sister took it over and as far as I knew, she wanted to. Well now she’s acting like she is some kind of martyr and asking me to pay my share of maintenance fees.
Two questions:
A. What would have happened if we just stopped paying it when my dad died?
B. Is there any relatively pain-free, non-scam ways to get out of this?
If it matters, it’s Wyndham

The contract died with your dad. Did she actually sign something with the company formally assuming the obligations? If so, that was stupid. If not, just stop paying, tell them your father's dead and the contract is no longer valid.

That’s exactly what I said! I have no idea why she assumed it. Thanks. I’m not letting her manipulate me for her bad decision.
Edit: Told her that and now she won’t speak to me. Ok good riddance, sorry you’re a dumbass.

If the timeshare is in the parents name and not in a Trust or Will, by default it is part of the estate. Normally the best approach is to notify the resort of the passing of the owners when the maintenance fee is received and do not provide any additional information. It is then up to the resort to determine if they want to chase for the maintenance fee. Sadly too many 'estate' attorneys ask about other property or assets and place the timeshare into the into the Trust or Will. The best thing is to leave them out and let resort to figure out what to do unless somebody, that is anyone, wishes to continue utilizing the timeshare. The primary reason for a Trust versus a Will is it reduces the chance of probate court where the timeshare resort can place a claim. Most timeshare agreements have a limited time frame of x years for ownership and define the process to return the unit to the resort. Also remember the timeshare agreement is not a mortgage, so there is no payoff of a debt and the maintenance fee is just that, a fee. If you look at the agreement, there usually is a clause that states if maintenance fee is not paid, you cannot use the timeshare. As for the people stating large attorney fee's not sure I understand, as property transfer stated in a will or trust is not automatic until any outstanding balances be it mortgage or fee is paid.

When a timeshare owner dies, in most cases the timeshare becomes part of the estate. That does not mean that your children have to inherit it. They can refuse the inheritance with a Disclaimer of Interest, but they will have to avoid using the timeshare or making payments from their accounts.

I figured that was the case. I thought she assumed it because she wanted it, I’m absolutely positive they wouldn’t have pursued anything if we followed those instructions.

Call the guy that started the "timeshare cancellation industry".

It's not your problem to get out of if you didn't sign any contract.

I once went to a Wyndham timeshare presentation/sales pitch in New Orleans. I thought I was going to have to fight my way out of there. They don’t take no for an answer, talk about high pressure .

Just like a living child, a time share moves in with next of kin by the law.

while we have had a timeshare for the family that has been used a ton and well worth it and been paid off for 12 years save maintenance fees we went to Cancun one year. we stayed at Melia Cancun hotel.
just for shits and giggles we went to their timeshare presentation to grab some free stuff and kill time.
wow. they were madder than hell when we told them no. they tried non stop to get us to buy. I thought they would send drug cartel henchman after us they were so pissed. we got the hell outta there.
