I feel sorry for TT fans. I would take Leach over Miles in a second.

Let's see: One or two guys who were cool with James go to his dad, who happens to work for ESPN, who has taken their employee's side, and they "talk"...

It's hard to convey how much fans and students here love the guy. I grew up in Lubbock, graduated with his daughter (no pics), and was even recruited by Mike Leach. Everyone here as a fan and student have been nothing short of obsessed what hes done for both the school and the city. It makes me as a fan furious that he was fired for such a minor incident if it was even an incident while there are more then a handful of coaches around the country being investigated for flagrant recruiting violations and even more coaches who just are flat out awful coaches. Everyone I know who is a Tech fan is beyond pissed about this and I have yet to find one person here stand up for the Tech athletics administration

Things have always been good in Lubbock other then his relationship with the higher ups. He was always seen around town, hanging out at the bars with the students shooting pool. And anytime there was a campout for games he would go up there with food and pizzas for the students

According to the NY Times writer, the judge was getting ready to sign the TRO letting Leach coach the Alamo Bowl when TT's lawyer pulled out the termination papers. I guess they didn't want to resort to firing him just yet but when they saw they were going to lose they pulled a trump card.

That's an interesting nugget of information that Leach's legal team will definitely bring up in court when they try to get the $800,000 bonus he'd have earned on January 1.

It's an old Tech tradition. Got banned in the 90's but right at kickoff as a show of support the whole crowd would throw tortillas on the field. If you go to a game now you'll still see 10 or 20. Before it was banned there would be hundreds

Yeah it's a funny thing about employment law. You can fire someone for no reason at all. But you can't fire them for a "bad" reason. Getting out off paying him a bonus he's due is a "bad" reason.
Now I have no idea what the law is in Texas. But there's an old Louisiana Supreme Court case from the 70s where a company did just this - fired an employee in mid-December before a bonus was due that would've vested on January 1st. That company lost.

LA is different because of the Napoleonic Code, but there's got to be a similar case in one of the 49 other states that shares common business law.

I'm taking the word of my Business Law instructor from when I took the class in college in Mississippi.
He made sure to bring it up because a big percentage of the student body is from LA.

As for whether firing a person for a bad reason will create liability, it depends. Normally, motives are not relevant in a breach of contract case. You have a right under a contract or you don't. Exercising a right, even with a malicious motive does not make it less right or more wrong. I don't remember the Louisiana case discussed in the post above. And I really can't say whether there will be any liability for Tech on the bonus or not.
What I really believe is that Tech was ready to do whatever to make sure that Leach did not coach on Saturday. No AD wants a judge to tell him how to run his athletic program. $800,000 or $1.6 million down the drain won't put Tech under. Allowing a coach to get an elected state court judge in Lubbock to overrule the AD ... well, that would create a dangerous precedent.
