This has not been the case for decades. The policy of everyone having to take the test has only been in place for a few years. We now have SPED kids taking the test along with Jumpstart kids who have no desire to go to college much less take the ACT. The decline of the scores can definitely be attributed to this.

I doubt it would wake up the black population as to how they’ve been taken advantage by Ds since the Great Society, but it might enlighten a few.

Here's a link to a history of the ACT. It verifies that 36 was the highest score from the inception. If your brother made a 35, that was exceptional. He probably got scholarship offers out the wazoo.
