Not sure worse attendance by others was truly shown in NY Times article that I read especially basing that on clock ins. Most companies allow for some tardies to be excused if employee calls before shift starts and in a timely manner when something comes up unexpectedly and causes delays.

It was clear they allowed for a lot of tardiness across the board. She also clearly was not written up every time she was tardy as she only had 2 write ups in first 7 months and then whatever ended up causing termination 3 months later. 47 issues of tardiness to get only 2 write ups and then a termination after final tardy issue of that 47.

Something more than just clock ins is needed to compare to other employees.

This lady’s main complaint for emotional harm was against someone she actually managed (or mis-managed). He didn’t make blanket statement about non-whites being lazy but mentioned that about specific ones. Calling one black employee autistic seems more an issue one way or another about autism than race. Asking his black female boss to stand by him while waiting for a black girl outside her work doesn’t seem to have harmed her as his boss (maybe hurt her feelings and purged herself for not feeling attractive enough to get same attention), and she didn’t do it. As a manager she probably needed to set better boundaries and expectations, and likely she shouldn’t have been hired to manage anyone in first place.

Her second complaint about her boss allowing a client to request a white trainer was dealt with a week later with the guy receiving a formal written reprimand. He also ended up being terminated later.

She was bulimic before she started this job, and she continued to be bulimic during it including purging herself several times a day. Blaming that on job is just playing victim. She was unstable and maybe still is.

She was given leeway on tardiness but probably due to her mental health made up reasons more than most. Probably had to purge herself before clock ins as well.

A mostly white jury in NYC decided all her issues in life including getting a scholarship to attend a secondary school growing up was from systemic racism not from anything she did and decided to pay her reparations through punitive award. The NYTimes writer is basically applauding these types of large punitive judgements based on social justice and is not very objective.

Where is more often and no punishment stated about other employees? The cbs story leaves out at her being the manager of person she is mostly complaining about and leaves out another reason for her allegedly being targeted (her complaining about her boss after allowing a person to request a white person as trainer being addressed as this guy was given a formal written up a week after issue and later termed)

Below is from NY Times article which mentions at least some consequences happened.

Also lawyer mentioned Swipe-ins which don’t tell whole story on tardiness policy being followed. If just being tardy got a write up she would have had 46 before termed not the 2 mentioned in article (2 in 7 months and then termed 3 months later without mentioning other write ups).

The person mentioned as her biggest issue in lawsuit was also her subordinate. Did she write him up each time or was she an awful manager? Or worse an awful person who was ok with talk and tardiness until she got fired and then had less money to eat food to be able to purge.

Sounds like she needs the Chutzpah Badge.

If her subordinate was worse than her at this and she wasn’t writing them up properly, that isn’t a defense for her being late, that is proof she wasn’t doing her job properly.
