Ok, no. Chugging a pint does not kill you.
Of whiskey after you have already had "10 too many"? It may......

Make sure the pint is full with water and food coloring to make it look like bourbon. 100% foolproof

This. But, if said theory would work, and purely for the sake of conversation; replace the whiskey with water. Or at least water it down significantly so there's still a hint of fresh whiskey on your breath.
Of course, there's always not drinking and driving.

Not the cops you have to worry about, they'll arrest you and book you. It's the judge and prosecutor and will it hold up in court.

The short answer is that a lawyer could get you off the hook with a slew of charges up to but not including DWI, and with likely the same penalties.
Drinking the whole pint is really dumb and you would yack in the 2 minutes you have to drink it. Leave it 1/3 full then just take 1 swig.

Follow Up Question: What if you chug the bottle once you get out of the car? Therefore you are not drinking it while inside the car. This would obviously have to take place the moment you step out of the vehicle before any kind of breath test.
Answer: That would definitely be an interesting case for a trial. You definitely would be charged with the criminal violation of drinking in public. However, if you submitted to field sobriety testing immediately after you consumed the alcohol, one could make the argument that the alcohol that you just consumed would not have time to impair you. However, that would most likely require the testimony of an expert witness for the state and could possibly skew the blood alcohol reading on the intoximeter machine for the “per se” charge (which just states that your blood alcohol was over .08).
All that being said, I can tell you that if I conducted a traffic stop and a driver exited the vehicle with a bottle in their hand, I would have serious safety concerns that they are intending to use that bottle against me as a weapon. Depending on the circumstances, the driver would most likely be immediately taken into custody and may not have time to take a sip. In many states, criminal “destruction of evidence” or “obstructing & hindering” charges could be filed on top. The question remains though, are you “in control” of the vehicle after you step out and consume that bottle? This would be a very interesting case for trial. I don’t know of any existing case where this has occurred and this would require some thoughtful “lawyering.”
If you pulled a stunt like that, is it possible to beat the DUI charge? It is possible. However, you certainly would face additional criminal charges that, depending on where you are, and the circumstances of the event, could carry a harsher penalty than the DUI. I will hand it to you though, you are thinking outside the box

Not reading all seven pages but I don't think the original idea would work unless you also refuse the breathalyzer and do whatever it takes to delay getting tested. The longer you can delay the test the more plausible the story would be.

Why do I always have to be the one with the obvious solution?
Pint Vodka bottle, fill with water.

Then they test the liquid inside the bottle and discover it's not even alcohol.
Best way I can think of. Step out of the vehicle. Drop the keys.
In view of his dash cam, break the seal and remove the top on your choice of liquor.
Chug half.
Refuse to answer any questions and allow him to arrest you.
DON'T do a field sobriety test.
Allow the blood test to happen.
Then have a good lawyer on deck.
Seriously though, stepping out of a vehicle at night time with something in your hand, especially when he's already suspecting criminal or drunk behavior, is probably a very easy way to get shot.

i haven't read all the pages but the answer is... heck yes, you can be charged. (I'm assuming you are already drinking when cop pulls you over).
Cop will do basic; walk and turn, 1-leg stand and HGN test. Based on that, assume you fail, cop will take you to closest station and give you a chance to blow in machine. You refuse = DWI; You take test = DWI. Lose-Lose Situatuion

Keep a pint of whiskey in your vehicle at all times. If you ever get pulled over after 10 to many you exit the vehicle immediately in clear view of the patrol vehicles camera. Close the door, toss the keys on the ground and chug the pint. Could they charge you with a DWI?
You'd probably get shot.

Wrong.
You refuse the field sobriety test.
An hour later when you make it to the breathalyzer or blood taking place, the alcohol that you just drank OUTSIDE of the vehicle on the cops camera is now in your system.
Your move.

Yes, you can certainly do this but it all depends on how the cop articulates your behavior, speech and how you did on the Field Sobriety Test. More than likely you will lose.

What behavior? You step out, chug, and say "take me to jail."
You don't do the field sobriety test or answer questions. Stand still, wait on the cuffs.

Why not refuse everything and answer no questions?
