Amazing what those 2 things can do. I really don't want anybody to drink and drive, but if someone does, I'd love to see them try this. I'm certainly not testing it though

We're talking about the chemical test done after your arrest on suspicion. It's either the real deal breathalyzer that's all certified and calibrated or a blood test. These tests are the ones that are used as evidence against you and cause you to lose your license automatically without questions or trial if refused... or, in this state forcibly taken from you.

So what is your excuse for not passing field sobriety tests? Chugging that won't make you immediately drunk, so if you fail the tests and then a blow test, I believe it will be grounds for a DWI. Your lawyer could try and argue that you failed the blow test due to chugging a pint, but not the field sobriety tests.

1. Illegal mishandling of evidence by a police officer.
2. Illegal purguring testimoy while under oath on a witness stand by the police officer.

Nah, just failure to collect it. I'll admit I'm fuzzy on the state's obligations here, but if they don't have to collect it, leaving it where it is isn't illegal.

I thought there was a thread on here a month or so ago about checkpoints in BR where the cops already had a judge on standby to sign off on the warrant for the mandatory blood test.
