Amazing what those 2 things can do. I really don't want anybody to drink and drive, but if someone does, I'd love to see them try this. I'm certainly not testing it though

Why would you take the breathalyzer after refusing the FST?

We're talking about the chemical test done after your arrest on suspicion. It's either the real deal breathalyzer that's all certified and calibrated or a blood test. These tests are the ones that are used as evidence against you and cause you to lose your license automatically without questions or trial if refused... or, in this state forcibly taken from you.

Are your directing that at me?

I know. The devices in the back of their cars don't mean dick. They just use them to verify their guesses of your drunkness after you've stumbled through the fst's

So what is your excuse for not passing field sobriety tests? Chugging that won't make you immediately drunk, so if you fail the tests and then a blow test, I believe it will be grounds for a DWI. Your lawyer could try and argue that you failed the blow test due to chugging a pint, but not the field sobriety tests.

If you don't comply to the breathalyzer they will pull blood anyways.
I know they have the option to take blood, but are they doing this regularly?

A fifth over a weekend is barely a buzz, bro.

Last I heard they're doing that exact thing in LA now. I'm not positive though. So don't quote me on that.

Your entire fricking argument relies on

1. Illegal mishandling of evidence by a police officer.

2. Illegal purguring testimoy while under oath on a witness stand by the police officer.

I am now convinced, you have got to be a cop.

Umm... Kinda hard to be thinking straight when you are 10 drinks past drunk.

Drunk is.08. Not but a few beers for an average size person. Are you a pussy who can't handle his liquor?

That would put you at 13 beers if you're 10 drinks post drunk.

I'm pretty good at 13. 18 is when the Dumbass comes out.

I heard the stories/threats a few months ago but I haven't heard of anyone being forced to take a drug test after refusing the breathalyzer. It is possible, though. Just a bit extreme for refusing the breathalyzer.

Nah, just failure to collect it. I'll admit I'm fuzzy on the state's obligations here, but if they don't have to collect it, leaving it where it is isn't illegal.

Nah, I just assumed you did enough wrong to fail the FST. Remember, the whole point here is that you ARE drunk before you get stopped and you know you're busted. Have we forgotten that part?

You're also convinced this tactic will work. Wrong twice in one night!

I thought there was a thread on here a month or so ago about checkpoints in BR where the cops already had a judge on standby to sign off on the warrant for the mandatory blood test.

A bottle of booze seems pretty important in a dwi case.

So let's say you have had a six pack and you refuse the FST. Where does the situation go then?
