First off, you and others have assumed we drove. There is no proof of that. No mention of driving was made. Secondly, it's not a crime to drink alcohol in America. Even around children. Your justification for her ruling is well, something bad could have happened. So even though it didn't, this dude is tottaly a liability based on purely anecdotal evidence.

Family courts are extensions of the nanny state my friend. As a man, you're at a disadvantage solely because of your sex. If your ex is taking you back to court, all it takes is a judge to feel like your ex got screwed in the initial proceedings for you to get punished. That isn't the law, but believe me, Family Court judges have so much discretion they can mask biases and prejudices much easier than other courts.
Having two beers at dinner should not cause you to lose custody or visitation with your children, as the activity isn't illegal and, by illustrating the time you were at the restaurant with the number of beers you drank, you should be able to show that you weren't legally intoxicated.
As for your lawyer, he won the money issue. And if the court granted an ex parte order to begin with, they weren't going to end it without a full hearing on the merits. We're not magicians. I would just set a meeting with him and tell him to be straight up: what do you need to do to win the hearing in September. Changing lawyers this late in the game is not a good idea.

I don't think this has anything to do with committing any crimes. That's the part you refuse to see. It has to do with the best interest of your kids, as you say. This isn't about "laws".

I can't help but feel like you're leaving out some important facts here.
If I had to guess, it's that while you average 6-7 beers a week, every once in a blue moon you toss back 4-5 a night and become a belligerent frickhead.

You don't have to be convicted of a crime for custody to change. I'm not licensed to practice law in North Carolina or where you said you are, but I'd imagine the courts there still look to what is in the best interest of the child.
You said you live in the Bible Belt and they aren't as tolerant about alcohol up there. Fact remains you still drank alcohol in front of your kids and drove home. Play semantics all you want, but it does speak to your judgment.
It's totally legal and not a crime for your ex to make out with and dance provocatively with a strange dude in front of your kids. However, if you had that on tape, you'd be screaming bloody murder if the judge didn't do anything. Because it speaks to her judgment and what she is exposing the minor children to.

If your wife is making an argument that you're putting the children at risk by drinking two beers at dinner, put a PI on her. See if she goes to dinner, has a glass or two of wine and then drives home. In order not to look like she drinks and drives, she's gonna say there's nothing wrong or illegal with what she's doing. This completely undermines her credibility, since she would have no problem doing the exact same thing she's taking you to court for.
