Woman is an idiot and the guy is a pussy.

I would argue he's more of a pussy than she is an idiot though. Oh no a little dog is running around me.....best kill it.....

As a matter of law, that's almost certainly how it will play.

As a matter of not being a douche/pussy, he probably shouldn't have kicked a small non-threatening dog to death just because it came towards him.

Not necessarily. If the dog is attacking then you should be able to use the appropriate amount of force necessary to stop the attack. But that would depend entirely on the situation.

No where in the report did it say the dog bit him. I am sure if the dog did, they 100% wouldn't have left that out.

So we know the man wasn't attacked, but he killed someone else's property. So either he is a pussy and is scared of a pug, or an a-hole who deserves to be sued.

It's obviously not life threatening, but who wants to have his ankle chewed on or get tripped by a yappy dog when he's out for a morning run.

Why not use your foot to sweep it away from you. Sounds like the guy didn't intend to KILL the animal, so I'd give him the benefit of the doubt.

I say the owner is to blame because she broke a law and could have prevented the whole situation.

Yeah if the dog is going back to the owner and he chases it down and kicks it, but that is just the dog owner's side of the story. The fact that her dog is off its leash puts her at a massive disadvantage.

Sorta my whole thing exactly. No one wants to be aggravated by some ugly arse small pug, but who really kicks a tiny dog that they know can't do shite to them?

He might not have intended to kill the animal (or he might have since he kicked the thing so hard it died), but if you don't feel threatened, who kicks an animal. It would take a few seconds to stop and let the owner catch up. Like I said before, he could have even called the cops afterwards.

But the owner does share fault. But it isn't a just him or just her kind of deal here.

It might put her at a small disadvantage, but she has a very good torts case if there is evidence that dog was running back. He used deadly force (whether intentional or not) on someone elses property while not feel threatened and she could probably also claim emotional trauma.

While I doubt a small pug can cause damage to a grown person, I understand moustache's point of view as well. It's also a matter of training your dog. I have a 25lbs dog, but he is ALWAYS on a leash, because while he "behaves" 90% of the time, he can also become aggressive and protective for seemingly no reason. I am not risking a lawsuit because my dog decides to be a little shite

Again, I don't think anyone is saying a pug is going to tear out your achilles, but I know I personally do not trust strangers to have up-to-date shots on their dogs and I think any sensible person would elect not being bitten by a dog over being bitten. Who knows how hard the guy kicked it anyway. It's a small dog, it probably wouldn't take much, but who knows maybe he really did only tap it and he just got it in the right spot.
