At 0.08 or even 0.1 you can make the tolerance argument. At 0.3 you cannot. There's not a jury in America that will say someone at 0.3 could consent.

She put herself in a dangerous situation. She probably had a drinking problem. She may have been promiscuous.
None of that changes the fact that a crime was committed.

I know a teacher at Walker High where one of the accused was in school. They were totally shocked by his involvement. Said he was one of the leaders in their classroom and trusted him completely. Just a terrible thing all around.

But to answer your question more generally, every single juror will be interviewed by both the defense and prosecution. The defense will find the black women (much of the BR juror pool) who don’t like white girls fricking black boys. Why else do you think this is such a tough case for Moore?

Ok, you are probably right but that doesn’t make you and that jury factually right in what you just ruled on.
You’d have to know all the details about the individual involved to make a sound assessment.

Your average Facebook replies aren't by people legally eligible to serve in a jury anyway.
Now that said, and I said this before, Judge Gail Horne Ray is a problem. Her son is a convicted rapist, and she has been lenient on rapists in the past ......all of that on top of the fact she is legally incompetent, in every sense.
I am not a lawyer and don't know the procedures, but if I'm the prosecution I'm seeking change of venue, or at least judge.
