How is this proper for the bar to look at?
from the Seattle Times:
quote:
Bellevue attorney David Nold asserts Avenatti carried out an illegal “pump and dump” scheme through his Washington state-registered Tully’s ownership firm, Global Baristas US, LLC.
Nold’s complaint contends that while Avenatti ran the company, he fleeced nearly $6 million in federal and state tax withholdings — money meant to be held in trust for payment of quarterly taxes — from the paychecks of Tully’s employees.
The complaint also claims Avenatti fraudulently transferred $100,000 from the Tully’s operation last year to retain lawyers for his California law firm’s unrelated bankruptcy.
typically lawyer-ethical rules contain catch all provisions punishing lawyers who engage in activity that affects their trustworthiness/integrity. so like in LA you can get in shite for getting convicted of a crime wholly unrelated to the practice of law
the fact that the allegations involve fraud and criminal acts means it almost assuredly falls squarely within the regulatory scheme

I thought the bar only looked at conduct related to one's law practice.
I have an attorney acquaintance who got busted on a DWI charge. They're putting her through the hoops with BS counseling and other qualifications she has to meet.
This isn't the court system enforcing these requirements. It's whatever board in Louisiana that overlooks these type of offenses committed by lawyers.

I guess it's time for CNN to run a few hit pieces on David Nold for ruining their golden goose.

The state supreme court enforces the rules of professional conduct for lawyers in many states. I’m not barred in Louisiana, but I am barred elsewhere. If an attorney gets disciplined in our jurisdiction, the state supreme court makes the determination unless the attorrney enters a consent order with the bar.

She was told if she didn't voluntarily enter into a counseling program, of the board's choosing, then her matter would be passed along to the supreme court of Louisiana.
What's frustrating for her is she's going through all this and her charge is very likely to be dismissed.

Your friend should consider speaking with an attorney about her situation. As the saying goes, an attorney who represents himself (or herself here) has a fool tor a client.
