Please show me where I stated that they legislate? My point is if they are acting as an official advisory committee don't they have to go through a process?

No. It's a purely voluntary advisory board, they have no direct power to actually make any cuts themselves but they can advise the president/executive branch. They are officially an advisory board by signature of the president, and therefore can gain security clearances and act as oversight for any agency or department the president wills
