Indeed.

There is a wide gray area between “prosecutorial discretion” and “ignoring certain state laws.” This is the sort of case which helps to narrow that gray area.

Which is why it will be an interesting case to watch.

Kidding. It was reasonably well-written. My recollection is that the 2017 case was not preemptive. The sheriff said some things at the press conference, but the were not included in Desantis’ Order.

Again, it will be interesting.

Can a governor suspend an elected DA for talking a big game, and then never doing anything? I don’t know. That is not how I personally read the constitutional provision in question, but it will be interesting to see it play out.

People tend to forget that these sorts of provisions can cut both ways. Look at California recently adopting Texas “bounty“ approach to private enforcement of state abortion policy and then applying it to guns.

More directly on point, look at all the sheriffs who have announced “gun sanctuary“ status in their counties… basically saying that they are not going to enforce statewide gun regulations.

Could a Dem governor in those states do exactly the same thing to those sheriffs that DeSantis is doing to Warren in this case?

The EO generically cites Warren's policy of refusing to prosecute certain crimes.

But, I don't think it's even necessary. Under Florida law, I don't think Warren stands a chance.
