If Bilbao would accept the 40mm from Bayern, the club, the 6mm in taxes would not be triggered. Because Bilbao is insisting that Javi pay his buyout clause, 40mm, and because Javi is a Spanish citizen he then gets an additional 6mm tacked on to the fee.
That's what is holding up the transfer.

Bayern would have to put 40mm in Javi's account. The Spanish government would then tax him 6mm on the 40mm that would be put into his account. That's hindering the transfer. Here:

The Spanish tax authorities are holding this up as is Urrutia with his attempt to save face with the crazy fans. That tax would not be included if the money would never be put into Javi's name.

Urrutia was orginally going to accept the 40mm from Bayern but because of the backlash, changed his stance and will only accept it from Javi so it won't look like they're trying to cash in on their best players.

Where is it documented that he was to accept the transfer fee from Munich?

It was always "we won't sell the play for a penny less than 40mm"
Bayern finally caved to that, with Javi willing to take a 2mm per year paycut over 5 years to pay the final 10. Then Urrutia decided he wouldn't take the 40mm bid. Instead, Javi would have to trigger his own opt out clause.

I'm sure his contract contains a recision clause.
As to the content of that clause, were it different than what he is representing, there'd be a big row over this, wouldn't there?

The problem isn't the clause. The problem is how Athletic Bilbao wants the clause paid. They won't accept the clause from Bayern Munich, only from Javi Martinez himself which then triggers 6mm more because he's a Spanish citizen.
They're holding a player hostage who wants to leave when they're getting twice his market value.

The problem is the clause. If they will only accept the fee from him, it is because that is what is stipulated in the clause, otherwise this shite would be big time news.

It is clear, if what I'm seeing on an Athletic forum is correct.
