Federal Circuit clears path for tariff refunds

In a per curiam order with no opinion, the Court of Appeals for the Federal Circuit yesterday denied the DOJ request for a 90 day stay on enforcing the Supreme Court tariff decision.

All of the executive orders issuing tariffs under the IEEPA have been vacated, and refunds of something between $130 - 175 billion are due. The thousands of refund cases pending before the CIT are free to move forward.

Are other countries tariffs illegal now too? I guess the good ole USA can keep getting screwed by other countries protecting their own interests and destroying our industries forever now.

Write your Congressman. Seriously. I am agnostic when it comes to whether we should have tariffs in place, but its up to Congress.

Or, just wait until Trump gets the economic reports he needs from the USTR so he can act under section 301 of the Trade Act.

Well the US supreme court doesn't decide what the law is in other countries, and they also didn't rule that tariffs are illegal.

Are these companies going to issue reciprocal refunds to their customers for the increased costs they passed on?

Do other countries not use tariffs to protect their own industries and prevent ours from having a foothold in theirs? Do these not negatively affect our industries here?

Most of the industries that used to make products in this country have left due to us not protecting our own interests like other countries do. When the options are made available for buying American made, I do.

That is a matter between them and their customers. A lot of importers will be signing their refund checks over to the businesses that ordered the goods.

The Trump admin chose to enact tariffs via a statute (the IEEPA) that did not authorize tariffs.

The President only has power to tariff if Congress creates that power in a statute. The admin chose the wrong statute when there are several other options that would have clearly authorized these tariffs.

They fricked up, bigly.

It's not any statement of our power to tariff, generally. It's about our administration's ability to read.

Especially a nice stimulus if you purchased rights to tariff refunds before the SCOTUS ruling. It almost like you would have had some insider knowledge.

My point was that the refunds will never make it to end users. It will be a windfall for importers and wholesalers.
