So then yes if he was out of bounds when it touched him, the kick should have been called out of bounds and ball on the 40 instead.

If he touched it while OOB, R's option is the 40, rekick w/penalty, or where it was OOB.
If he touched it and THEN the ball went OOB, it's the OOB spot, R's ball.
Now, what was the play...exactly.

The Eagle player reached for the kick off, it seemed to have touched his fingers. Then it landed in bounds, might have grazed the Eagle players forearm when it bounced up at the same time the players foot was clearly out of bounds. The ball was then recovered by a Cardinal player.
The refs called that the ball touched the Eagle players fingers and landed out of bounds so the ball was dead at the spot where it went out of bounds. the Cardinals tried to challenge the play but it wasn't challengeable.

The key is where was the player when he first touched the ball. Inbounds or OOB
The ball is dead as soon as it touches anything that is OOB.

The refs ruled that the player touched the ball inbounds while he was trying to catch the kick off, then the ball landed out of bounds.
