Mostly correct. The issues are whether Benson had requisite mental capacity to make decisions he made and, if so, whether he can do what he wants under the trust docs and trust law.
However, evidence as to Gayles past may be relevant (though admissibility is another issue) as the theme is she is a schemer gold-digger. Evidence as to Rita, not so much.

Is it really illegal for a rich old man to give away his money to a charming younger woman? A lot of the lawyer posters keep acting like it can be, but it seems like there'd need to be some serious attempt at defrauding and misrepresentation on Gayle's part. Short of finding a coconspirator like Rob Lowe in Tommy Boy, how would you even prove that?

Absolutely not. No matter how much it pisses off the kids or makes others turn up their noses. "Forced heirship" is antiquated and very, very limited. It would take an overwhelming amount of solid, reliable evidence that the younger woman, through deception and misrepresentation, took advantage of a doddering old fool that was mentally incapacitated.
There is no evidence that Gayle Benson comes anywhere close. The crap about her past business ventures is really nothing remarkable. Jesus, business people are sued all the time. Thank God!
