I don't think it matters if Smith "hit&run" Hayes' car. You can't murder someone for that.

The video shows Hayes stopping quickly in the road, and Smith coming close. You can't tell if there was an impact in the video and if there was it certainly wasn't a bad one.

Then he chased him down and rammed the back of his car with the Hummer? And murder him and shot his wife?

I don't agree with that.

Also, so Hayes just pulled over and then got enraged that Smith left the scene because he wasn't hit?

People have had road rage for less.

Aka, a guess, not a fact.

I see no impact. None. Neither do you.

and that Will was standing next to his car, got shot in the back and somehow ended up with his arm over the steering wheel and his feet still on the ground?

now the lawyer is saying oh they may have slightly bumped the hummer but there was no damage. slightly bump my vehicle and drive off and I'm not letting it slide.

IT JUST DOESN'T MATTER.

You can't murder someone because of that.

Oh I'm well aware and have argued it extensively.

The previous supposed H&R is utterly irrelevant.

H&R or no H&R, the man put 8 bullets in his back. And 2 in the wife. There is going to need to be cold hard evidence that Smith brandished a weapon for him to get away with this.

I don't think anyone is arguing that Hayes should be getting off free & clear. the argument is that Smith escalated the situation in his own way and all these people (Payton, Brees, citizenry) and acting like he just got shot for no reason at all.

This isn't like in football, player fumbles but the refs call a player down. They review and have no angles showing the ball touching the ground and uphold the call.

So you're telling me that because you don't have a side by side shot of the 2 vehicles, you can't prove there was contact? Again any reasonable person will say that's a H&R.

Unless Smith had a gun on him, he did get shot for no reason. The supposed hit and run has nothing to do with that.

so Will's wife was out of the car, by the drivers side and was shot first. twice.

then Will was shot 8 times.

this changes everything.

its like the 3rd or 4th different account of how the shooting happened that we have gotten from various people close to smith, though the first direct from a passenger of the car.

id give her version some extra weight obviously, though some of it seems to run against what we see or have heard.

Attorney: Will Smith's gun was "in compartment in the vehicle the entire time."

IF true, Hayes is pretty fricked.

quote:

Attorney says he believes that Racquel Smith was deliberately shot, not a victim of crossfire or stray bullets.

IF true, this could become a 1st Degree case.

(3) When the offender has a specific intent to kill or to inflict great bodily harm upon more than one person.

No. Just no. I oten use video surveilance at my job to conduct inspections and try to determine root causes of incidents. there is NO CONCLUSIVE evidence that impact occurred. There are 2 vehicle impounded that will determine if impact occurred. Period.

Hayes' perception may not equal reality.

No they won't. And it will be easy enough to prove by examining the vehicles, but that video doesn't prove anything regarding contact.
