If I had drank nothing before exiting the vehicle, drinking a pint would put me over the limit... But I drank it after exiting the vehicle....,

I've often wondered this myself. Of course they would be able to get you for public intox and all that jazz, but it sure seems like the dwi would be hard to pin.

I'm pretty sure that the rate the body absorbs alcohol is constant regardless of how fast you drink the alcohol.
In other words, you can't chug a fifth and your BAC will automatically jump to .15
If the cop breathalyzed you immediately, he would still get an accurate reading of how much alcohol was in your system before chugging the fifth

Request a blood test, by the time they get a sample it would be in your system.

Ok, true story that is relatable.
Friend of mine is shite-faced drunk driving around town (he's an alcoholic). He gets into a wreck with another vehicle. It's a pretty bad wreck, but no visible injuries. He calls the cops to come to the scene, and tells the dispatcher he's across the street. When he hangs up he goes across the street to a bar and orders 3 drinks. Sits at the bar and downs them. Cops show up, people point out that he's in the bar. He explains that he was so shook up from the accident that he had to get a drink to calm his nerves.

Uhh...you'd still be drinking a fifth at one time that's all being absorbed into your bloodstream. No shite it would be more deadly than spreading a fifth out over a weekend.

I was riding with my buddy and we were both wasted, he missed a turn and runs into a nursing home.
We haul arse and leave his truck there so he's charged with hit and run or leaving the scene whatever but no dui
We did spend the night in jail though when they found us
