this is going to be the problem...I let the dog out to go to the bathroom without a leash, but that is because I am with him, and no other neighbor dogs are out when I do it.

ETA: My dog listens to me that is why I let him out without a leash, with my gf he goes outside with a leash unless I am outside...

he has not attacked anyone or been attacked when I am with him

I think he's saying since it occurred on YOUR property, the neighbor's homeowners policy might not cover it.

that's what I thought, I was just looking for clarification.

If I do bring my dog to the vet, they will pay for the damages, or else I will lawyer up

If your GF is not a resident of your home she can collect under your HO Policy Medical Payments Coverage up to the limit (usually $500-1000) regardless of cause or liability. Just has to get hurt on your property. This would not prevent you from also collecting from the neighbors HO policy if they are determined to be negligent. The dog bite does not have to occur on their property. They are responsible for being in control of their dog regardless of location, be it your yard, dog park, walking down the sidewalk.

So you and your GF rent the house. Does the neighbor/dog owner own their home or rent? If they're renting they would have to have renters insurance with liability coverage to have any insurance to cover a dog bite.
