They were presumably within the course and scope of employment or acting on behalf of Lyft, which means that Lyft's insurance could be primary, which means Lyft MUST be included.

You would rather them sue the driver personally than Lyft's insurance? That is weird.

What did Lyft the company do?

You realize all you're doing is arguing for continuing operating in the same way that has our insurance rates through the fricking roof right?

Was the person driving for Lyft at the time of the accident? Were they in the Course and Scope of Employment, Acting for, or on a Mission and Errand for Lyft?

Would Lyft's insurance be Primary? if so, you have no choice. Louisiana is a Direct Action State.

Lyft isn't going to have any "personal responsibility". Nothing is going to come directly from Lyft. You have to include them to include their insurance.

Are you under the impression that they are trying to get something directly from Lyft? Holy shite

Agree it sucks for him. But he was probably going to be called on to testify as a witness in the case regardless, even without being named as a defendant.

Again...If they were working for Lyft at the time, LYFT MUST BE INCLUDED in order to sue Lyft's insurance as well.

Louisiana is a Direct Action state. They are not trying to get money directly from Lyft nor will they.

Some state's are NOT direct Action and you wouldn't need to include Lyft. Louisiana requires it.

If he wasnt on the clock working for Lyft at the time I would agree, however, if he was on a trip getting paid, he would 100% be covered by Lyft.

They probably already subpoenaed Lyft and saw that the driver was on a ride call on the clock and that's why they named Lyft.

Yea and hike this poor Lyft guys insurance rates to the moon and continue the pattern of bullshite lawsuits which contribute to Louisiana leading the nation in insurance rates.

You're right, I don't get it.

A Lyft driver struck and killed her, while working for Lyft.

They have to sue Lyft, the driver, and their insurance, because Louisiana is a comparative fault state.

And the fertilizer companies that protected the crop. And the municipality that provided the water to irrigate the crop. And the petroleum companies that provide the fuel for the Lyft driver and the tractors. And on and on and on.

Seems to be a disconnect where they think going after the insurance somehow doesn't result in more money coming out of my pocket

Correct, because they will not pay anyone directly.

And in this case it probably won't be affected much. But normally yes your insurance would go up.
