I agree. But if she would not have put herself in the situation things would have turned out different.

Sure......

But more importantly, if you have a working penis at 0.3 BAC you deserve a medal!

You can say that about everything in life.

Your bad decisions don't give criminals a free pass. If I walk through the hood with a racist shirt on, I will probably get unalived. Doesn't mean it wasn't murder.

Guy, I don’t care if these guys go to jail, I don’t.

That said a lot of men have been put through the ringer, lives ruined over misinterpretation of a situation. It’s happened multiple times now where cases have had to be overturned.

Let’s make sure before we damn all these men.

That’s all I’m saying.

I agree about men having their lives ruined.....but This isn't some girl claiming "me too" after a night of bad decisions. The girl is dead, and a crime was committed.

How were their "preconceived notions" determined? Are you just making this up?

Judge Gail Horne Ray is a problem. Her son is a convicted rapist, and she has been lenient on rapists in the past ......all of that on top of the fact she is legally incompetent, in every sense.

If she believes her son is innocently jailed, she'll never let these boys get convicted. A wronged mother that happens to an idiot is a huge girls for the prosecutor. A fair trial isn't happening in that courtroom.

How about this zinger from her last year

Grossly erroneous’ decision to free rapist reversed; district judge criticized by higher court

quote:

BATON ROUGE, La. (WAFB) - Louisiana’s highest court has reversed a decision made by 19th Judicial District Judge Gail Horne Ray.

Judge Horne Ray, in April, tossed out the 1973 conviction of rapist Donald Ray Link.

Link was only in court in April to request being allowed to become eligible for parole.

Since when do potential jurors get interviewed?

All potential jurors receive a questionnaire tailored to the case and then go through Voir Dire, where they are asked specific questions by the attorneys. This has been happening since America was America.

No. For 3rd degree rape, the 0.3 is enough to convict, even in isolation.

They're all charged with 1st degree aren't they?

Her BAC was 0.3. You cannot consent at that level, and that is exactly what 3rd degree rape is. They are guilty of that, at minimum.

Serious question, what is your BAC cutoff for someone who is too drunk to consent? And do you thing that every person that has had sex with someone over whatever your arbitrary number is should be found guilty of 3rd degree rape?

There are obviously grey areas at lower levels. Our government decided we can't drive past 0.08. O.3BAC is severely intoxicated, questionably conscious, and not up for debate as for as consent goes. As I said before.....

Lucky for you...if you are blacked out drunk and get hit by a car stumbling on Burbank...and one or all of those 3 guys have sex with you...it was rape. Even if you gave verbal consent.

.08 is NOT too drunk to consent.... .3...is "drunk, drunk!"

But this will never go to trial.

A better analogy would be

You walk through the hood with a racist shirt on. Then people yell at and argue with you for being a racist, which is why you went into the hood with a racist shirt on in the first place. Then you get run over because you were stupidly out in the middle of the road in the middle of the night and die.

You've never known an alcoholic before. Blackout drunk doesn't mean passed-out.

There are people so drunk they have no memory of their actions the night before, but at the time carried on conversations, ordered food, and unfortunately drive their cars.

jody, not sure if you are aware but we have numerous raper experts on this board. they all saw video of the girl scurrying across the road. therefore she wasn't raped.

Well I was talking about comatose people.

If they are capable of doing all of these things how is someone supposed to know they are too drunk to consent?

I've been trying to follow all of this, but I haven't seen a clip that shows why she is calling him a fig. Just saw the clip where she calls him a fig and says to let her out of the car. Not saying a clip like that doesn't exist. I just don't recall seeing it. You got a link to that? Thanks.
