Don’t know where this is, but it wouldn’t in Louisiana. Or, that aspect of intent wouldn’t. We have Simple Battery, Second Degree Battery (serious bodily injury), Aggravated Battery (weapon), and Aggravated Second Degree Battery (both). Unless your “intent” makes it up to Attempted Murder, it’s outcome based, not intent based.

I cba to do a survey of their statutes, but most places don’t have a “you hit them, and you meant to really hurt them, but you only managed to annoy them” law on the books, at least until you get into the attempted murder range.

That might explain why I see situations where I’m thinking attempted murder and someone is only charged with battery.

If I worked at McDonald’s and someone did that to me I’m dragging them behind the counter and dunking their whole head into the boiling french fryer. Completely disfigure them for life.
