Wasnt he killed in his drivers seat?

If so, thats hardly shooting someone in the back. The guy could have been on side of the car and started shooting and Will Smith turns away to either protect his wife or just reacting to being shot at.

Not defending the a-hole shooter but holy shite people just jump to conclusions in a millisecond on here

They just said Mr.Smith had just had diner with the cop accused of killing Hayes dad. That seems strange.

And the cop was nowhere near the scene apparently either....

Probably protecting since a bullet found her leg in the process of it all.

Sounds like he got back in his car and shithead came up to his door and opened fire into the vehicle.

The charge is 2nd degree murder.

If the story about Will Smith having dinner with the cop that killed suspects father has any merit, one would think the charge would be 1st degree.

But I guess they can upgrade charges as I'm sure they are still investigating.

1 million dollar bond seems appropriate to me for such a crime. Anyone know what is common?

Should have been no bail tbh. You've got multiple witnesses, one being a victim, should have been denied.

No reason he needs a chance to run or opt out.

It would still be 2nd degree murder. In LA, difference between 1st and 2nd degree murder is additional factors not premeditation.

Why not 1st? He shot two people..

Shooter did not have specific intent to kill or injure Smith's wife. Only had specific intent to kill Smith.

I'm just curious why he also isn't charged with attempted murder for shooting his wife

Very strange and an indication that it was not just a random act of violence.

Is it possible the perp thought the cop was the driver?

Then why did one of the bullets fired from his gun to into her body?

No, they argued before he shot him. He knew it wasn't the cop.

movies frick it up all the time. same with bullets traveling through water

Wrong, water is one of the best ways to stop a bullet. 2 feet would easily be enough to stop even a .44 magnum and that is a much bigger handgun round than you will find on the street
