Exactly.
If BP were not to pay now, they would likely disqualify themselves from placing responsibility on a third-party and end up paying after they were sued.
BP can claim a third-party, TO,etc., was responsible, but under the OPA they need to cooperate and pay right now to reserve that right.

Lawyers are licking their chops and everyone even remotely connected to this frick up will be sued, they will all sue each other to find the deepest pocket. Money, Money, Money......Money.
