Although randomly shooting an animal is a felony offense under code 42.092 b2, the Texas penal code does allow for control of depredation by domesticated living creatures including strays under 42.092 f1b
"It is an exception to the application of this section that the conduct engaged in by the actor is a generally accepted and otherwise lawful:
(1) form of conduct occurring solely for the purpose of or in support of:
(A) fishing, hunting, or trapping; or
(B) wildlife management, wildlife or depredation control, or shooting preserve practices as regulated by state and federal law;"
Depredation as defined in TPW code 71.001 (10) "Depredation" means the loss of or damage to
agricultural crops, livestock, poultry, wildlife, or personal
property.

Is there any gray area in this thread?
Or is it: ALL SHOOTERS VS. ALL NON-SHOOTERS?

I'm not talking about
I'm addressing the fact that just because there is a leash law doesn't mean people can kill dogs that aren't on a leash.
I fully recognize and respect that there are times when shooting a dog is legal and justified. Don't try to make this fricking complicated, because it isn't. This is very simple.

I think each side keeps saying there is gray area but neither have agreed to disagree

Well the OP was about dogs running deer on a deer lease and wether you would shoot them so yes it is about depredation control.
I posted it as simple as it is.
There is a leash law that requires owners to control their animal. this law does not give non owners the right to shoot the animal
There is also and exception to the animal cruelty laws that allow for the control of depredation on your land which gives owners the right to shoot animals harassing or damaging wildlife or property
There are also exceptions for animals that are being agressive or dangerous but no one is really disagreeing on that.
There is that not

I've not read a word of this thread, but of course you shoot mongrel dogs that repeatidly jack your hunting up. And obviously you never shoot a dog that you think belongs to some decent human. That's the rules. And I've had a prize beagle shot through the hips with a thunderhead. If I ever find out who did it I'll knock his frickin teeth out.

How do you make the jump from a couple dogs jumping up deer and scaring them off to be the same a damaging? When you saw "harrasing" you mean like the dogs are going to give the deer bad dreams?
If the dogs aren't attacking and eating the dear then no depredation is taking place.

I've never shot a dog, though I used to guide quail hunts for a guy that wanted me to shoot a couple of pointers that would jump the quail and grab em. I couldn't do it, but they hadn't pissed me off. I've never had to make a decision on shooting a dog either, though I have had them run by me on a stand.
BUT... Bleeding Purple has totally owned this conversation. He has said many times that he is giving the owner and dog the benefit of the doubt, not once but twice. And if I'm not mistaken, he originally said that he warns the owner of what could be, on the second visit.
He has also stated that he hasn't had this situation happen, only that this would be his procedure. He's given you laws to back up his reasoning, and has had a pretty even keeled argument since the start.
I think it's time everybody chalked it up to this: Some people look at dogs differently than others. Nobody is going to
change the others mind so let's drop it.
Bottom line, if I spent a couple of grand a year on my lease, drove across the state to hunt it as often as my strenuous job let me, and every time I got there all my deer cams had were dogs and all I saw in the stand was dogs.... Well by God, I'm killing me a dog!!

Dude, this has never happened. The bottom line is that this is a hypothetical. The ultimate flame.
If I were you I'd shoot a damn dog too. I wouldn't be going home empty handed.

Yeah you just highlighted the part of my post that discussed a hypothetical situation, and told me it was hypothetical. I know that, which is why I'm saying to move along!!

quote:yes, i would feel pretty good that it was somebody else laying on the floor instead of my kids, wife or me, but, you probably wouldn't know anything about that sort of stuff...BTW, you don't know the law, so if you are in law, might want to try something else, or at least pay attention in class...
bet that'd make you feel really good. Why would that be worth going to jail?

i have been reading this thread off and on the past couple of days. i am kind of up in the subject.
however, i found out last night that our neighbor in mississippi dogs got loose a few days ago. these two family pets (pits) came onto my mom's property and killed one of her horses. these dogs will be shot if seen again and dropped off at the owners house.
i wont kill just to kill but now there is reason.
