"You completely misunderstood what I was saying. What I said was there is no fraud here but there is a lot of perjury going on. Some might argue that perjury is fraud but it’s already called perjury so why confuse the issue with calling it fraud."
Sorry for the confusion, but it is a function of the reporting on what should have been a major development. The only reporting I can find on the dismissal is based on the very thin AP story about "an opinion filed more than two weeks ago" without a link to the actual opinion.
I don't know what else I can add. I actually took the time read the Amended Complaint, which you can here:
Zimmerman Amended Complaint 2020
There are 7 causes of action. None of which are explicitly "fraud." The third cause of action, civil conspiracy, plainly states a claim, which, if TRUE, would provide relief for Zimmerman.
Of course, it would be nice to read Judge Cooper's elusive order, but it is hard to imagine this part of the case being subject to a motion to dismiss. It's noteworthy that the motion to dismiss was granted THREE YEARS after the suit was filed. No doubt that Zimmerman was flooded with all sorts of motions that prevented any fact finding in the case.
My guess is that Zimmerman ran out of money to pay lawyers...and Crump et al succeeded in stopping any examination of the fake witness. In a sane world, you would think the DOJ would look into the matter to see if Zimmerman’s constitutional right to a fair trial were violated. Maybe that would have happened under a different Attorney General.
