Honestly, and I realize this is probably gonna come across a little sassy, but I’m convinced that as a general matter there isn’t going to be much reasonable or rational commentary on this subject from anyone other than attorneys, and even more specifically from those who practice criminal law. There’s just way too much nuance and procedural aspects/obstacles and subjective factors for the non-lawyer to identify and factor in. I see an epidemic of oversimplification and ignorance of (no insult) a vastly more complicated matter than most will understand. If you know, you know.
I may not approach “expert” status on many subjects, but on this one I’m pretty confident, having bounced back and forth between the defense side and the prosecution side. I’m currently the latter, so I’m not exactly talking outta my arse…..this time. Muahahahaha
