Lower courts are going to do this until SCOTUS changes or clarifies its opinion on this issue. Yall realize they (district courts) are following current law from higher courts on this, right?

The only thing dumber is the two current replacement options for filling seats: appointment to fixed terms and/or elected judges. The former would result in constant vacancies that can’t be filled because of Congress and overt pressure to be pro-administration, and elected judiciaries are a fricking disaster.
Single-term appointments could work, but it would be to be 10 or 12 years or so.

it really is a conundrum. Either way I actually love messing with govt worker buddies about it. Always fun watching them get pissed off when you stick to your guns that they “really” don’t.

McCarthy and George Wallace of all people warned us about Federal judges. Both were wrong about a lot of things but they nailed that one.
