This is the scary part. There are probably many more businesses in NY alone that have done this. And they will never be pursued like Trump. The pretext opens all kinds of possibilities to attack political opponents going forward. Remember, this DA campaigned for the job by stating he would get Trump.

he shouldn't have called paying his lawyer "legal fees" especially negotiating and completing a legal contract. We all know that's sheetrock.

If that would have happened,Cohen would have had his balls in a vice. I would imagine with invoice numbers, check numbers and amounts that would have taken about 15 seconds to figure out.
He was in a no win situation and from the looks of it, one of his biggest issues is the people he depends on for advice.

It's a novel legal theory, but it's not necessarily wrong. It's just really really really bad optics to use this novel theory to prosecute a former president.
1. Trump used Cohen to pay off Stormy. Instead of correctly labeling it as a payoff, or paying her directly, he called it part of his retainer fees to cohen. This is just a misdemeanor.
2. The novel legal theory is that Trump intentially did this to hide the payment because he wanted to run for President. Thus raising this to a campaign finance violation and making it a felony.
That's my attempt at a laymen's explanation.

This where I think Trump attorneys failed. Trump is the brand of Trump businesses, this has been stated and argued many times in the media. So if Trump is the brand then the payment to his attorney is a legitimate expense.

Trump claimed he didn't sleep with the porn star, he didn't know about the payments, and it was all something the Cohen did without his knowledge. That was his defense, His not-guilty position is why this happened. The trial was to show Trump knew by showing evidence and testimony from his inner circle.
If he had just pled no-contest it likely would have never seen a court room, be less than a week in the news cycle, and then forgotten.
Having his wife and daughter with him might have helped the jury believe him. Its pretty obvious Trump asked and they refused. Ivanka is likely creeped out her father imagines his whores look like her. And Melania is just watching the clock.

He could have properly identified/classified the payments such that they complied with campaign finance laws and New York state’s laws regarding fidelity of business records.
This is simple stuff.
