Are we certain about this? I ask because I would never expect SCOTUS to do this. They will cite "disparate impact" as the rational legal basis for retaining the race-based districting, IMHO.
As such, we should all be shocked and surprised to our core if SCOTUS should decide to Rule that race-based districting is Unconstitutional.
I don't think they will - they will cite the "disparate impact" legal doctrine as the reason for Ruling that race-based districting is Constitutional.
