I would be shocked if less than 90% of those living in a subdivision with new construction had not done it in multiple homes. "Oh ok, this is where the kitchen is going to be honey. It is a lot bigger than our kitchen. I really like the tray ceilings in here" etc etc......

I don't doubt this, I just don't see any potential for this to change the legality (or not) of the events that occurred on the street.

Like I said, I fully expect them to take a beating in a civil suit, but I think they walk on criminal charges.

Aggravated assault that led to murder. They had no legal basis to attempt a citizens arrest.

Still don’t know why this guy had to die. He may not have been a choir boy.

I understand that the MSM typically seeks to wrongly portray the victim as a choir boy to heighten the divisiveness between racial and political factions. I have a big issue with how guys like this are portrayed in such a positive light, but that’s necessary to draw attention to the crime. If they reported the guys known faults then few would care. It’s classic media manipulation.

The above stated, it still does nothing to change the impression that those ole boys had no cause to take this guys life.

Correct. There was no felony (a required element). The only reported crime was criminal trespassing (a misdemeanor). They have to observe it (they admittedly did not) or have direct knowledge of it (they adminttedly did not).

All they have (from the police report at the scene) is knowledge of the subject from videos they had previously seen (who provided those videos to them - that is going to be interesting) entering the construction site.

This is going to be incredibly ugly. Monumentally stupid.

The caselaw is light, as citizen's arrest issues are very uncommonly litigated, but the Georgia courts have said that the "in the presence of" language still applies to felonies.

This seems strange. Why would the language include "reasonable suspicion" if the requirement was direct knowledge "in the presence of".
