WTF does Amy Berman Jackson think that was all about?
She is an effing Judge for chrissakes! Innocent until proven guilty and all that rot ..... but meanwhile, let's strongly imply guilt to the jury pool.
Then gag the defendant.

This may be true in theory, but is patently false in practice. Law enforcement has contacts in almost every news station in America. Additionally, the news media reports on pending criminal cases largely from facts obtained in public charging documents or information provided by those working for the prosecution, both of which provide only one side of the story. A gag order generally only silences one side and it isn't the prosecution.

He’s facing criminal charges and has a right to a trial by jury. He can waive the jury and have the judge decide whether he’s guilty or not. If he has waived the jury then I think your point about a gag order to not taint the jury pool gets a little stronger- there would be no jury to taint.
