Thats kind of the issue, right?
If everyone were upstanding and took care of their stuff we could all be libertarians.
Unfortunately in the real world where we share property lines and spaces, the option seems to be a few bad apples ruining an area or karen overreach.
There isnt a perfect solution other than laid back people running HOAs with as little intervention as possible IMO.

Yes, it's a contract that runs with the land.
They can run a foul of the Constitution or public policy.
For example, you could have a stated condition that no black people may own in a neighborhood. That would be unenforceable.

excellent, I've been wanting to get a fixer-upper Altima but haven't had room in the garage. Now I can park it in the front yard while I get around to it. Might even put it up on cinder blocks.
