quote:
Bragg is saying the law does not differentiate between state or federal, just that a crime was committed.
And that's the legit interpretation of that law.
The issue is if the DA connected those dots enough, and it seems they went for a more esoteric approach (that probably won't be upheld on appeal). Should have tied it all to Cohen and let the chips fall where they may, which would have been 100% sound, procedurally. Riskier? Yes, but actually legitimate.
quote:
If I were the USA in The SDNY I would tell Bragg that he (the USA) will begin transferring all similar cases to his office going forward since he now sees himself as a defacto Federal Prosecutor.
I don't think it's that dramatic.

This case has nothing to do with Federal Election law according to Merchan.....where did the prosecution say that? They never said that. What do you mean? Stop putting words in the judge's mouth. Who said you have to prove which specific state statute the defendant was trying to cover up? No one is saying we have to do this. What are you trying to say, that Merchan does not know what he is doing, or that he is wrong in his ruling? He's a judge....no really, he went to school for this.....has the papers to prove it? Lookit, he's giving the jury 4 possibilities....at least
Awww you know what, if you think he's wrong, there's always an appeal, amirite?

It probably is not and I was engaging in hyperbole. But if Bragg wants to get into the habit of using state law to hold people responsible for violations of federal law, I know many aUSA types who would not mind it.....if only for the fact that their caseload would go down....you know, more time with family and all that shite.
