The only issue that I see is burning political capital. Senators, by and large, if they are RINOs, will be pissed. This could hurt in other areas or nominations to his cabinet.

BREAKING News: Trump has sent word to the Senate Majority Leader Thune that if the Senate doesn't confirm AG Gaetz, he will appoint him using the Federal Vacancies Reform Act of 1998, which allows for temporary appointments for up to 210 days, with a possible 210-day extension. This individual would not require Senate confirmation.

If you believe that matters to Trump I don't know if you have been paying attention. He gives no fricks and is going to do what he campaigned on regardless of the blow back.

After reading a little of the Federal Vacancies Reform Act I don’t know if they can make him the acting AG.
