Second, you’re correct, but I wonder how durable that is. I am staunchly opposed to the death penalty but I tend to think SCOTUS’s Eighth Amendment cases don’t have a lot of objective backing. The two broad schools of thought:
• Original intent / what it meant in the 1780s—really hard to argue executing child rapists is contrary to this when rapists of any kind could have been executed for their crimes as recently as the 1970s.
• Living document / what it means today—pretty sure for better or worse that most Americans have no problem with executing child rapists lol. I don’t really think SCOTUS should make itself the arbiter of what is morally acceptable in today’s society anyway, but even aside from that, I just don’t think the average person thinks executing child rapists is cruel or unusual at all.
