Yes, and if you're actually recalled this is a UCMJ case and a surefire win. That's why Tatoo Pete wants it to be administrative. Keep up. I know you really want to keep missiling survivors in the water, but saying "you can refuse a lawful order" will never be conduct unbecoming.
Also, reserve officers aren't recallable that way, but I'm sure Kelly was USN. The services are using reserve more lately than they did when I was in.
