Thanks for the updated forecast. For those who prefer dry seats and footing, covered seating helps.

Adoree, is that you?
To VJM41: Your revisionist history is incorrect. Saban coached here for 5 years, not 4. 2000 was his first year, and 2004 was his last. And, it was Miles's recruit who quarterbacked us to the 2007 National Championship game. Remember Ryan Perriolloux?

To Eagle of War AU: You obviously are not capable of making a point. First, get your homeboy "thatguyrightthere"' 9 inch dick out of his mouth, and pay attention. The only thing I see is your attempt to measure your program with LSU's. You called out our recruiting class, which by the way is ahead of your team on Rivals but behind on Scout's. But, don't let that fact disturb you. You then posit that Saban is the reason we are a top program, but you conveniently ignore the fact he left over 6 years ago, and you ignore LSU's record under Miles. You pathetically flame our coach by saying he is a master of Special Education. I suggest you try not lumping all LSU fans into your groundless conclusions. It only spotlights your feelings of insecurity about your own program. As for Elite versus 2nd tier, I have not made that distinction, although it will be interesting to see if AU can maintain its level of success achieved this year on the football field for the next several years. Until then, go suck your boy's 9 inches.

To Eagle of War AU: Considering LSU's historical record against Auburn is 24-20-1, I fail to see the point you are making with a comment such as "LSU was just considered a mediocre team for a long time...Til a certain coach came and LEFT". Actually, if you had bothered to look up the records on this site, you would have realized Saban had a 2-3 record against Auburn, and our Special ED coach owns a 4-2 record against your beloved team. But, don't let the facts get in the war of your feeble flame attempt.

rules and caps on liability rarely apply, if negligence is proven.
Negligence does not need to be proven in worker's compensation, only an accident, and injury, and resulting disability.
Separately, if the state is proven negligent (road defect, design, construction), caps do apply. If a physician is negligent, a cap applies. Topics for another day...

TROLA, you missed the last part of the last sentence of the OP. He said another employee "caused the accident."
quote:
Either I'm missing something or she doesn't derserve any p&s.
You're missing something...Accidents, by definition, are the result of negligence. If the same accident had been non-work related, she would be entitled to recover compensation for her pain and suffering. The difference is that the law is different for a work related accident as opposed to a non work related accident.
Her claim is limited to 2/3 of her wages, capped at the maximum compensation rate (which gradually goes up each year), plus medical under the medical reimbursement schedule. For example, if she was making $100,000.00 per year, she would get the max comp. rate, which is a little over $500/wk. for length of time she is temporarily and totally disabled. If she is capable of doing light duty or other duty, then the maximum amount of time she can be on indemnity benefits is ten years. As a part of this ten years, she would qualify for supplemental earnings benefits provided she is not able to earn 90% of her pre-accident wages. There are no elements of recoverable damages like pain and suffering, loss of enjoyment of life, or other general damages in worker's comp.

The family's priorities would include paying for the funeral, putting food on the table, making sure the mortgage is paid, and paying for the birth of the second child. Calling an attorney to make sure these things are taken care of more quickly only seems to be the first priority of survival. I know the family, and evil is in no way, shape, or form a motive. The only evil I see is writing such thoughts in a public forum.

Wow....a thirty year old man loses his life, has a 2 year old, a baby in the womb, and his wife files a lawsuit against the companies that caused the loss of their father, and now they are to be referred as "leaches"? WTF?
