NYT: Prosecutors Seek Trump Lawyer’s Testimony, Suggesting Evidence of Crime

The prosecutors have sought approval from a federal judge to invoke what is known as the crime-fraud exception, which allows them to work around attorney-client privilege when they have reason to believe that legal advice or legal services have been used in furthering a crime. The fact that prosecutors invoked the exception in a sealed motion to compel the testimony of the lawyer, M. Evan Corcoran, suggests that they believe Mr. Trump or his allies might have used Mr. Corcoran’s services in that way.

Howell, the chief judge in the Washington federal courthouse, who oversees all grand jury matters.
But after his appearance in front of the grand jury, Mr. Corcoran received notice that the Justice Department was seeking to use the exception to break through his assertions of privilege, the people familiar with the matter said. Judge Howell, who has consistently decided in the government’s favor on privilege issues surrounding Mr. Trump, will ultimately rule on the department’s request about Mr. Corcoran. She will be stepping down from the position of chief judge next month.
The push for Mr. Corcoran’s testimony is another sign of the aggressive efforts being made by Jack Smith, the special counsel overseeing the investigations into Mr. Trump, to secure testimony. Mr. Smith is guiding both the investigation into Mr. Trump’s handling of the classified documents and the inquiry into Mr. Trump’s efforts to remain in office after his election defeat in 2020 and how they led to the Jan. 6, 2021, assault on the Capitol.

As a recovering attorney I would go to jail rather than testify against a client. If they wanted to charge me with a crime that involved time....real time, so be it. No matter I would not talk for shite. If I went to jail, I would then go jailhouse lawyer on the state....or federal government and then attempt to get as many prisoners to clog up the dockets as possible with appeals or civil suits.

Has NYT proffered their opinions as to FJB's legal perils?
You know, in regard fo his illegally stored, illegally possessed and illegally taken classified docs from his VP days?
I don't think they have.
That could add an aggressive dimension to the DOJs "review" of FJBs classified documents.
Did the reporter think to ask Merrick Garland how the special counsel's work on FJBs classified documents is going?
Who am I kidding. I know better than to expect that.

The one this OP brings to mind due to some similarity with Trump/lawyers/privilege questions is when the story leaked that the Feds had gotten hold of the Michael Cohen/Trump discussion of the Karen McDougal hush payment in the Cohen raid, Rudy leaked that the conversation on the tape was exonerating, so Cohen's lawyer responded by released the tape in order to call Rudy on his spin. Cohen eventually pled guilty, accused Trump of directing him to do it, and did time for the crime.

This sounds ominous, but all Trump news starts this way and ends up with a Mullergan.
