Can NIL be structured with a base pay plus incentives like bonuses?

Say in the case of Leavitt asking for $4 M, but his return from injury is unknown.

Could he be given $2M up front and the rest when he's fully recovered and practicing with the team?

I’m sure there are loopholes, but remember that NIL is for name, image and likeness. It can’t be tied to pay to play.

It CAN be but it has to be competitive.

Like if another school will offer the $$$ w less strings attached you’re just hurting your own ability to recruit/sign players….

Based on the shite that was in DWs contract that his “impartial “agent allowed him to sign you can put pretty much anything in it.

Seriously I’m sure you could put some injury related clauses in the contract but would he sign it seeing as he seems to have pretty good leverage?

You don't understand the meaning of NIL if you're asking this question. NIL is about individual agreements between a player and organization (not LSU). Every player has the right to negotiate whatever terms both parties agree to. NIL cannot be limited or prohibited in any way unless congress passes new antitrust legislation for the NCAA (e.g. NFL).

NIL is more like a media / marketing contract. Say you sign with a communications company to do X amount of 30 minute radio guest appearances. You’re not getting paid to play football but people know you and want to listen because you play football for LSU.

Certainly.

You can include bonuses for winning a National Championship, Heisman, Outland, Walker, All-American, All-Conference, or other awards.

I realize that, but his name, image, and likeness is less if he's not seen on gameday qb'ing the team. If I am employing him to do autograph signings, be in commercials, etc then i need him on the playing field to increase his value.

I don’t think LSU has anything to do with NIL. I forget the name but a corporation was formed, I’m assuming non profit, with a board of directors. They deal with the athletes NIL. That cooperation has a contract with a large marketing / media firm that secures deals with small, medium, large companies for all types of people, singers, models, celebrities, athletes etc. Deal with Monster Energy gets secured for specific or multiple players, NIL cooperation negotiates said deal for said player(s). All this NIL has to be approved if it’s over $600 by the Clearinghouse. Having an NIL structure setup like above is how they can exceed the RevShare which is about 15ish million for football.

Then you have RevShare which is controlled by LSU I assume.

I know enough to be dangerous with information.

NIL isn't performance based. Performance based would indicate pay for play and they universities are adamant the players aren't employees.

Now it could have a morality / suspension type clause that states if the player is ineligible due to conduct then they lose out on money.

The problem with your plan is let’s say LSU offers him this, but some other school comes along and says “frick it. Here’s $4 million up front to be our QB.” Why wouldn’t he just go to the other school?

These conferences DO NOT want these athletes reclassified as employees. Hence the name change from pay to play and name image and likeness.

Everyone seems to not understand this with sports contracts. The players/coaches are simply pair what the market will pay them. “Prove it” deals only get accepted when nobody else is willing to pay a player/coach.

But NIL can pay a player X amount and that can be for as little as one appearance.

If it can't be tied to pay to play, how can it be tied to block a player from entering the portal?

if a player is being paid and his name is mud because he isn't playing due to a previous injury, then that isn't going to make fans enjoy supporting the product his name is attached to. It could be a major backfire.
That is why this Leavitt injury is making things so complicated. If not for the injury situation and him not even practicing until next fall, I would be ok with giving him a chance. But under the circumstances and his asking price, I think it is a really bad decision by LSU and could derail our 26 season to be similar to the 25 season .
Clark is a much safer get and there are other good QB's that could push him, just like Simmons did at OM.
