On what evidence do you base your assertion that BP personnel are culpable and not those of Transocean?

Don't forget MMS. You hear in the news how all these pieces of equipment were bypassed or broken etc. What you don't hear is that MMS signed off on a lot of that and gave BP permission to run like that. Ummm.. wasn't MMS's job to protect and safeguard against this type of thing? So why did they give BP permission to do these things! Sounds like they are a big part of what went wrong.

I am told that the OIM, Offshore Installation Manager, and his senior staff will bear most of the blame.
Transocean Ltd. employees onboard the Deepwater Horizon drilling rig when it exploded in the Gulf of Mexico have become the focus of a U.S. government probe into the cause of the fatal disaster.
Stephen Bertone, chief engineer on the rig, and Mike Williams, chief engineer technician, were designated as parties of interest yesterday by a joint U.S. Coast Guard-Interior Department investigative panel. That boosted to five the number of Transocean workers who could face criminal charges stemming from the accident that killed 11 people.

MMS did not give permission to Transocean to run in bypass. What a rig does once the inspector leaves is on them. The approvals granted by MMS for any rig is based off of the info given to them by the rig itself. Had the rig reported any broken equipment MMS would not have allowed them to go foward without the equipment being fixed. Wether are not the rig reported honestly seems to be the question here and it would seem they didn't. MMS does not monitor rigs 24 hours a day. Any one can put something in bypass the second the inspector leaves and thats just the simple truth of the matter. Approvals are granted on a daily basis by MMS engineers in the office. Its not something they do in the field. MMS does rely heavily on industry to work honestly and if they don't bad things can happen. That's not the MMS's fault.
Its like saying its a health inspectors fault for a restuarant owner poisoning its custumers the day after his inspection. Its absolutly rediculous.

I am not saying MMS gave permission on all the screw ups but to say that they didn't know about some of the things that were done and didn't give BP/Trans permission to proceed is just false.

Actually you did. You can't say without any doubts that MMS knew anything about any of those things that went wrong before hand. Its not false to stat an opinion about something that at this point can't be proved right or wrong. There is nothing to support your arguement as fact either, so we will just have to agree to disagree on this matter.

That alarm wouldnt have done jack shite to stop that blowout and save those guys lives. And theres no way the elec tech is gonna get implicated as being responsible for this incident. Geez people get your head out of your arse.

As far as the feds are concerned (this happened in federal waters), BP, as the designated operator of the lease, is 100% responsible for what goes on during any leasing holding activity.
I agree that it is looking more and more that this incident will turn into a criminal trial.

FYI, the MMS would NOT "sign off" on people putting required safety devices out of service. What would make you think that they did. MMS inspectors are NOT on the rig 24/7. They check the required safety devices, but a company can easily put them in bypass the minute the inspectors leave. Please quit making statements with ZERO evidence to back them up.

Regardless of whether BP is generally responsible for activities occurring during their lease, criminal negligence would never be imputed to an individual merely because he is employed by the operator of the rig. It is immaterial who the operator is if an employee of the driller is found to be the criminally negligent party.
