Audio/video recording a conversation

Question for the crowd. Is it legal/ok to record someone without them knowing?

My dad is having a building (garage) built in the middle of his property out in the country. The hired person to do this work has been video and audio recording conversations between he and my farther. He never told my dad that he was going to video the conversations until a week ago. This has been going on since November.

My dad is a 70 yr old disabled vet and i think my dad is being taken. I'm in town now to help him out as hardly anything has been done but my dad did pay 16k upfront. To make things better, the guy is my new brother in law. There are things done that i know my dad would not want done but he says my dad told him but didn't remember.

Yes. As long as the person recording the conversation is part of the conversation, it is okay to record the audio. If the person recording is in a place that he/she is legally entitled to be, he/she may video with only a few exceptions. In neither situation must the other persons being recorded be told.

If one person in a conversation records the other person doesn't have to be made aware, at least in Louisiana.

One party consent law says you can. The state matters, google it.

Depends on the state.

Louisiana is a one party consent state which means only one party has to consent and have knowledge of the recording.

Some states require both parties to consent.

If your dad lives in the same state as you, fl is a 2 party consent state. If your dad is 70, we are probably close in age. Do you remember fsu kicker scott bentley, in the early 90s, getting arrested for secretly recording an interaction

So he paid him $16k upfront in November and little has been done? I am not sure why he would be recording your pops if he is trying to scam him. Maybe he is hoping he says something he can use against him?

To record someone you usually need a person's consent and it is definitely something worth asking the guy about.

Did your new BIL recently get out of jail? Cause this sounds like something a shady contractor who was recently in jail would.
