That's an uncivilized way of thinking. Outside of an actual threat with action towards that threat, no speech is grounds for an assault and battery.
Not saying the fan is blameless, but Smart's actions were unreasonable and, technically, criminal.

Watching the video he is getting up focused on the court and then immediately he turns around as if he heard something. At the same time you can see Jeff Orr leaning down and saying something. Smart was getting up to go back on the court. It's very Clear Orr made a comment and then smiled and tried to backtrack when Smart turned around.
Smart shouldn't have pushed him but at the same time POS like Orr should have their tickets taken away for life. You can heckle but when you start getting out of line the fan is at fault. He's had prior issues to boot, he flipped off the kid from Texas AM. Hell an Okie St player from the early 2000s has come out and said he remembers the guy and the horrible/ridiculous shite he would say.

No justification for it at all. Orr is a dirtbag, YouTube him and you will see, but invoking the Jeremy Hill defense is flat wrong. Smart is in college, it's a learning proces. He could of gone pro but opted to stay. There is something he wants and needs from the college experience, unfortunately this is a negative one for him, but good can come from it.
Once again a in the heat of battle mistake on the part of Smart should not be turned into anything else, especially in light of the fact that all we ever hear about is crowd noise, playing with emotion and all the sundry cliches. Smart got caught up in the emotion, mistake made. Lesson hopefully learned.
