How do you figure? The dude in orange repeatedly made threats on the life of him and his father, when they clearly had weapons (not pointed at him). They told him not to come any closer, and he continued to be insanely aggressive. Then he went and got a weapon and went to attack (with intent to kill since that’s what he’d been screaming), and got exactly what they told him would happen if he did.
Well for one thing, they are charged with murder.. and I imagine a jury will see the video and decide that people like this shouldn't get away with killing?
What weapon are you referring to? The bat he tossed at them and clearly missed them with, by about a mile.. To which they had guns and lit him up, to the tune of what, 4 shots? It wasn't necessary action to fire at him. And certainly not to this extent.. because he threw something and didn't even make contact..
You are forgetting these people, allegedly, drew the weapon on him PRIOR to the incident. They never even denied the claim.. and again, in front of his kid..
Seriously f these pieces of trash. So what if he had a bat.. and big whoop if he tossed it.. he was clearly upset from their prior actions and acting ridiculous.. but they seem to have possibly initiated it all, and they continued to allow it to escalate.. as well as inviting him to take action so they could retaliate. Sorry, but I would not give people like this a pass.
They are every bit as responsible for the situation. They had several opportunities to walk away and let the authorities handle the matter. Instead they rather escalate the situation and even encourage the man to, "take a swing." You must have missed those words.
Life is too precious to take away so easily. This is beyond disgusting and no reason to defend such action. It's flat out disgusting.

If no shooting had occurred, the father and son would have been in trouble just for brandishing a firearm. But because the guy in orange escalated things, I think they can use self defense as a justification for shooting.
This seems contradicting. They brandished the weapons even prior to any of the filming going on. Their brandishing of the weapons seems to have possibly initiated the entire thing. You hear the man talk about how they pulled guns on him in front of his kid right?
I would love to see laws changed to address the inviting of using your weapon. Saying things like, "I wish you would swing on me." While holding a gun and fully ready to kill someone, should not be self defense. They shouldn't get a free pass to murder someone who is clearly irrational at the moment.
quote:
Dead guy got what he was asking for. Stand your ground laws are a bitch to folks armed with baseball bats. Orange shirt shouldve seen what he was up against and backed down.
He should have, but again you don't go shooting unstable people if it's not necessary.
This is terrible logic.
They had a poor man with brain damage that walked into the wrong apartment and got shot because he wasn't all there and couldn't respond to verbal commands. All this fricking killing, because of guns, is just too damn much. And I'm not even anti-guns. I just wish some people could use better judgment if they are going to own and use them.. and these two clowns have no business taking a life like this.. over some shite.
I am very interested to see if anything else comes from this.

Downvote me if you must, but none of the people involved in that video should be able to own a gun.
Exactly! x's about a billion.
Some thought Will Smith’s murderer would get off. He got 25 years.
Hopefully these idiots get the same and are never allowed to own a gun legally again.
If they did initiate the dispute by pointing a gun at him then they should be held responsible even more so. That probably set him into this irrational behavior. He probably felt frustrated and as if they were taunting him. Then at some point they invite him to get violent.. knowing they can just shoot him. They never denied the claim of drawing a gun on him. They probably backed off once they knew the lady was recording, but ultimately the first opportunity they got, they lit him up.
Regardless of anything though, these people do not need to own guns. I like to know what happened exactly prior to the recording. If he got a bat once they pulled out the guns? I just don’t know how anyone can be as prideful as these two idiots that they rather kill a man than walk away and get the police. They rather initiate all of this drama. I’m interested to learn about the prior actions, before the recording.
It almost reminds me of a suicide by cop type of situation, except for these people didn’t have to escalate this being so prideful. A cop is going to talk a person down. These people wanted a reason to shoot this guy, multiple times? He threw a bat and missed..? Unless I saw it wrong? It’s hard to see.. I remember a time when people threw stuff at each other and then got in a fist fight.. got arrested, maybe served time, and matured over the years.. better times I suppose.
If necessary, we do have laws, police, and judges for these types of situations. Let them handle this crap. Both parties were so stupid.
I believe I read the wife moved her family from there. That’s the right choice.
I’ve read a similar situation before where a girl could move her family from a similar situation (neighbor seems like they could kill them.) however, they didn’t move, because they didn’t want to give the neighbor the satisfaction.. I have always advised them to move if they can. it’s not worth being prideful over. Now if it’s a situation where you grew up, or your family built the home, or it had special meaning.. then I understand and agree with staying.. but it wasn’t any of that. They had nothing like that and moving wasn’t an issue.. just didn’t want the neighbor having the satisfaction. Pride... maybe the most special of the seven deadly sins.

That’s usually how it works. Or do you think parents should have to bury their kids? I’m confused on who you think usually dies first

I admit I don’t know the stand your ground laws, but I would like to see if there can be specifics added to it.
For example, if you brandish a gun first.. initiate.. etc.. and then you encourage the other party to act.. especially a party you actually know or have ongoing disputes with.. then if they act as you said.. (depending upon specifics of course) then you basically forfeit qualifying fully for self defense. To me, self defense wasn’t intended as a built in way to legally kill someone you clearly have issues with.. but this whole stand your ground idea seems to be that very out for *some* people.
People want to rile up others then when they get mad and want to fight you over it, you just shoot them.
I admit the guy was an idiot and should not have tested them.. but he lost his cool and he paid for it. I think all parties are in the wrong here and they still need to be held responsible.
With that said, I’ve made my peace over this and will move on until the trial, if it gets to that.

1) Someone, anyone, pulls a gun on me in a verbal argument*.... I go the other way immediately.
2) Who in the their right mind hands a baseball bat to a guy that is in an insane verbal argument with two guys opening brandishing weapons and threatening to use them?
3) What kind of spouse takes a video of this without ...see item # 1

Not siding with the shooters in the least but do we know for sure that they just strolled up with guns because the dude was leaving a mattress out?

I don't care how stupid the victim is, you don't give in and go shooting him.
This is down right heartbreaking.. they just killed that man.. the woman's husband.. and he has a kid.. and they already pulled the gun on the dad in front of kid(s)?
I understand rights and stuff, but idiots like this should not have guns. Can't go getting upset or in an fist fight with anyone these days..
This is just not the self defense stuff I can get behind. They should have walked away and if needed, call the cops and have this sorted out.. not take matters into their own hands and murder someone's father, who is obviously upset.
All parties involved are white trash doing white trash things. I am not justifying any of it because it could have been resolved much better. It still doesn't negate that all parties involved are white trash and played a stupid fricking game.

I'm willing to bet that the root cause of why they brought weapons to the alley is directly related to the root cause of why they also didn't have shirts on.

i tend to agree with you... i mean yes, maybe bat clown was a posing a direct threat at the time of blasting, however old dude, continued to provoke, almost as if he was hoping for exactly what happened. a multitude of lives changed because 3 mf are too trashy and too stupid to take a step back and realize just how stupid they are. its amazing to me how dumb some frickers are.
and is it just me, are does old dude not remind any of y'all of the old dude from pawn stars are whatever it was??

I would like to point out that the son, while being pretty trashy, was relatively well spoken and quick on his feet with his insults. Did you hear how he snapped back with "cocksucker".. thought the rednecks were seemingly calm and didn't want to have to shoot the guy. Seems like a hotheaded family of Florida transplant thought they could just dump their trash behind their house, but that is where little Billy target practices. Hothead thought he could bully the guys, but forgot he's in Texas. Blam!

End of the day, this was a pride thing. Swallow your pride and go home, don’t die. Guy has a gun, expect him to use it.
Also, if someone tells me “I’m going to kill you” and comes at me with a bat, I’d probably shoot him too.

This part of the statute on self defense in Texas law will frick him.
