You are incorrect. There is no duty to retreat on public property in Texas. As long as you are legally allowed to be there (not trespassing on private property) you are good to 'stand your ground'.
It's going to get sticky because you also can't provoke your attacker. This is where the lawyers are going to focus.

I would say yes under many circumstances. In this case, though, it seems orange shirt threw the bat after being shot once or twice. At least you see fatty dad duck to his left after firing some rounds. The shooter can't claim self-defense at that point, IMO.

I mean, the father and son were standing their ground. They never raised their guns or stepped towards the man in the orange... until he started towards them with a bat. The old man told the guy in the orange exactly what was going to happen if he came within 3 feet of him. I think the old man is free and clear, not sure about the son.

Don't know or care who is right here. It just boggles my mind the dumb shite that people are willing to kill/be killed over. Like was that really with getting blasted over? And is it really worth going to prison over? Holy shite. There is very little that would possibly make me pull my gun on my neighbor. And if he pulls one and gets the jump on me, you can bet your arse I'm not gonna stand there and fricking threaten him and argue.

Eh you can't really be standing your ground if you are provoking, The old guy was repeating "come on" and other taunts etc. Thats why he is no longer only "standing his ground". Everyone involved in this video and is in the wrong. If he did not taunt orange shirt, then I would consider that he was just standing his ground.
Orange shirt definitely darwin'd it up by bringing a bat to a gun fight.

Fat boy is going to jail. He was not in danger and fired his weapon after the other 'tard fired his. This was not self defense on his part. He will do time, particularly if his shot was the fatal shot. I don't know about the other guy, because the video got bad seconds before shots are heard.

this. why on earth did she think she could tell 2 people with guns that they will not shoot her husband, (who is getting a bat to escalate the situation) instead of telling her husband that this game is over and its time to leave.
