Yep, but he also has no retirement as it's tied up in the business. In Alabama they split retirement 50-50. So they throw yours and hers in a big pot and split it down the middle. If she has a ton in her pension you may be able to keep her off the businesses.
The old, I'll leave your shite alone if you leave mine alone approach. It's not a widely communicated law in Alabama but you are definitely entitled to 50%.

Apparently AL isn’t a community property state so there is no automatic 50/50 for assets acquired after marriage.
She’ll likely have a claim for the business acquired after marriage. The one you had before is a different story. Her pension is fair game for you- that’s your leverage.

Thank you. Yeah, my attorney says her claim to my business I've had since before marriage is very weak. Thing is, I had a nice 401k that I cashed out to buy the current business. The business is my retirement. I hope the mediator takes that into consideration.
