I have to explain this to people for a living.
Imagine telling an innocent person to stop telling me why they're innocent and that it doesn't matter right now.
I do tell them to go home and write a narrative with pertinent details, people to contact potentially, etc. But that doesn't matter until you get the state's evidence. The prosecution has the burden based on their evidence, and fighting a prosecution is about combating their evidence.
Again, it's not about what happened, it's what the prosecution can argue based on what evidence they have.
I am not discussing what happened. I'm discussing what evidence the prosecution has, and how that affects the prosecution.

Slow, how will they spin that the driver admitted that 2 had sex with her.

And I don’t think the argument that the delay in doing the rape tests being the problem is sunk. Just because you could still pick up DNA somewhere doesn’t mean you could still pick it up everywhere

It raises questions that are quickly becoming huge holes in their theory.
Again, it only takes 1/12 jurors to think one other explanation is reasonable. Not likely, not definitive, reasonable.

We will never know exactly what happened, frames of mind, etc. The trial won't rest on this, either. The trial will be all about what evidence there is, and if the State can present enough evidence that is deemed credible enough for the jury to eliminate any other reasonable scenario that could be interpreted from that evidence.
The lack of DNA is bad for the case. REALLY bad.

What he means is the lack of DNA evidence makes it harder to convict without other hard evidence but he has communication issues.
