You’re a smart guy but I’m laughing that you don’t or wont recognize the box you’ve set up. No big deal…

I have to explain this to people for a living.

Imagine telling an innocent person to stop telling me why they're innocent and that it doesn't matter right now.

I do tell them to go home and write a narrative with pertinent details, people to contact potentially, etc. But that doesn't matter until you get the state's evidence. The prosecution has the burden based on their evidence, and fighting a prosecution is about combating their evidence.

Again, it's not about what happened, it's what the prosecution can argue based on what evidence they have.

I am not discussing what happened. I'm discussing what evidence the prosecution has, and how that affects the prosecution.

Don’t get me wrong, rape is always wrong. But the notion a woman is freed of all responsibility for her actions while intoxicated while males are just as responsible while intoxicated as sober is just wrong. Either men and women are equal or they’re not.

We’re not equal. Women need to be protected and cared for because they aren’t as capable as men in virtually every aspect of life. The deserve our protect. Of course them deserving our protection also means the don’t deserve the same rights as the men who have the responsibility to take of them.

Slow, how will they spin that the driver admitted that 2 had sex with her.

He was lying, he is racist, he is blind, what?

And I don’t think the argument that the delay in doing the rape tests being the problem is sunk. Just because you could still pick up DNA somewhere doesn’t mean you could still pick it up everywhere

Bill Burr had a great take on this.

Never been to college I see

By “active participant” I meant that a penis doesn’t typically wind up inside a vagina by accident (despite what PornHub might have to say about it).

But yes I’ve had my share of experiences where I went from an “active” participant to passed out next to a rather disappointed lady.

A girl is getting physical with a guy and says she wants him and she agrees to sex. She initiated it and he agrees. By the law, the male just raped her.

But…what if the male is drunk? If she’s so drunk, she doesn’t know what consent means, then how can the drunk male comprehend that she’s too drunk for consent? Why isn’t the male too drunk to know what consent is? Why

And why isn't this rape by the female? That would never get prosecuted. Law is bogus.

How does he know what actually happened? He's going to have a hard time saying he saw penetration from the front seat.

It raises questions that are quickly becoming huge holes in their theory.

Again, it only takes 1/12 jurors to think one other explanation is reasonable. Not likely, not definitive, reasonable.

Why are you believing the defense when the prosecutor says that’s not all the evidence

yeah. I wouldn't believe anything the defense says with the admission of rape we already have.

I’m guessing since SFP is an attorney, and all of the non-attorneys on here are trying to make legal arguments?

No kind of opposite. I'm trying to discuss/explain this from the litigation/prosecution perspective and not guessing what actually happened (which will devolve into a shite show based on prior threads about this incident).

We will never know exactly what happened, frames of mind, etc. The trial won't rest on this, either. The trial will be all about what evidence there is, and if the State can present enough evidence that is deemed credible enough for the jury to eliminate any other reasonable scenario that could be interpreted from that evidence.

The lack of DNA is bad for the case. REALLY bad.

The physical evidence now argues the opposite. Not having DNA destroys a lot of the proof of rape.

Is rape ok if the rapist has whiskey dick and can't finish?

Its hard to believe that dude is an actual lawyer.

What he means is the lack of DNA evidence makes it harder to convict without other hard evidence but he has communication issues.

Is rape ok

No. Never.

That's not what is being discussed by lacking crucial physical evidence to prosecute a specific crime.

quote:

if the rapist has whiskey dick

Are you asking if it's rape if the male has whiskey dick? that depends on if he penetrated the alleged victim at any point.

and can't finish?

Already addressed with statutory citation.

Where is the information about this:

quote:

An autopsy revealed that Madi had “injuries consistent with a prior anal sexual assault” as well as her injuries from the accident.

From:
New York Breaking

Or
quote:

Brooks had trauma consistent with anal rape.

From:
WFLA

Seems like you answered your own question.

You seem way too emotional for this discussion.

Calm down and ask a better question.

I am calm, answer the question

Since you said

and it seems someone entered somewhere

That just SFP’s way of reminding everyone that he’s an attorney and clearly the smartest guy in the room

His ego is so fricking massive it’s unreal
