Holy shite man. I believe it has been stated at least 10,000 times.
1. Get out
2. Drink bourbon
3. "Officer, I refuse all tests. Take me to jail"
4. DONE
The only test you take is the blood and/or breathalyzer at the station/hospital, that is now INADMISSABLE, due to the evidence that you drank alcohol outside of the vehicle, and nobody can prove beyond a reasonable doubt that your BAC, as tested, was elevated before that drink.

There's still going to be whatever is on the dashboard cam from before you got out of the car and the cop's testimony about any glassy eyes he saw, slurred speech, stumbling, even if you refuse the FST.
We're drunk, remember?
You can't on one hand say that we're going to chug a pint of whiskey to throw off the cops because we know we're drunk and about to get busted and then immediately turn around and say that there won't be any other signs that you were drinking and driving that the cop can testify to.

At a level of. 08 I don't think many people have glassy eyes, slurred speech, stumbling etc..
Remember,. 08 is only about 3 beers.
Now after 13-20 we're in a whole different ballgame.
I'm referring to drunk in the legal terms of.08,not "go streaking" drunk.

It should be said, I'm definitely legally drink right now.
Not driving though, somebody else will have to test out this theory.

Good. If you tell the cop you're not legally drink, you're definitely busted. Now, it's time for me to go meet some friends and get legally drink.

If you don't try anything, you get a DWI. If you try something like this, and fail, you get a DWI. Why not try?

I was told this by someone in law enforcement and it makes sense.... kinda.
IF you KNOW your to drunk to drive and you get pulled over, show the officer your ID and place your hands behind your back. DO NOT SAY A WORD. Dont answer any questions besides, "all the info you need to know about me is on my ID". They WILL arrest you.... Dont consent to blow or field sobreity, just let them arrest you. The officer WILL be pissed, he will threaten you and will attempt all he can to make you answer questions or comply. With no proof on the amount of alcohol in your body, they cant charge you. Get a lawyer as soon as your released.
Like i said, this is what i was told...

Definitely DUI is worse, but in Tennessee implied consent isn't a slap on the wrist either. It's hard to fight against an implied consent violation because you denying to take the field sobriety tests is on camera and going that route eliminates any possibility of actually passing the field sobriety tests/blood tests and getting charged with nothing.
But if you're definitely over the limit and 100% going to fail the field sobriety it's best to agree to nothing and take the implied consent violation.

Yea I agree, I was reading the penalty for implied consent in TN and it says basically they can susp your license for 1 year. In my profession, a DWI can severly effect my license to work, then my job and income is at stake. Ill suffer thru a year not driving just to keep the DWI off my record.

If all of you idiots are assuming that the sole reason why a police officer is pulling you over is because he suspects you of being drunk, then your plan to guzzle a pint of whisky when you get out of the car will only serve to help convict you at trial. Per your assumption, there must have been some erratic movement that you made in your car that drew the officer's attention in the first place. Erratic driving + clear evidence of consumption of alcohol = conviction. If you don't think you are really drunk, then you might consider taking the breath test to offset your stupid move of drinking liquor outside the car.
If the officer had no intention of pulling you over for DWI in the first place (your light might have been out), then consumption of the liquor when you get out of the car will definitely put that in his mind.
The safest - but apparently least acceptable (on this board) - means of avoiding DWIs is to NOT DRIVE DRUNK IN THE FIRST PLACE! If you have any reason to suspect that you are too intoxicated to drive, then DON'T DO IT!

Yes, they could and would still charge you. No doubt.
The more interesting case would be the guy that meets buddies at bar sober for 3 quick shots then immediately leaves for 5 minute drive home. He should arrive home legally sober unless stopped and delayed for DUI testing.
