You'll still fail FST.

I've always been told to get out of your car, give the officer your license, tell him your not answering anymore questions, and tell him to take you to jail.

Admittedly, I was at the Christian St. stop sign about to pull onto Perkins, leaving Chelsea's at 10 PM. I fought the DUI for 2.5 year and eventually won. I didn't blow and had drank 3 Abita Ambers at Chelsea's with dinner. I was running back to my house in the Garden District and was going to come right back, but Officer Mickey Duncan had other plans.

ETA: When the Officer asked if I had been drinking that night, I did tell him I had 3 Abita Ambers with dinner. He acted like he had never heard of Abita. It was weird. I guess he just wanted me to say I had drank beer.

if you're using this last gasp, damage control forensic countermeasure(BAU term), why would you compromise the situation further by submitting to any tests?

I would consent to a BAC test conducted by a registered nurse or doctor only.

If I remember right, you can be given a DWI just for being behind the wheel of a car with the keys in the ignition while intoxicated.

The only point of chugging a fifth is to throw off the breath test. You have to go through the FST to get to the breath test.

It would allow time for the pint to absorb into my system. It would take an hour plus for a cop to get you to the hosp/clinic to conduct the test.

Here is the flaw with your plan: if you have such a problem with drinking that you have to plan in advance about how to attempt to beat a DUI, then you lack both the intelligence and the fortitude to keep that pint of whiskey in your car at all times. Your going to think "I'm OK to drive and I'm out of whiskey, so I'll just drink the reserve bottle and replace it later." And of course, you end up drunk and forget you drank the reserve bottle so the next time you drive drunk you get popped.

Enjoy your new boyfriend in jail.

Why not just use an empty bottle? He won't know it was empty when you fake chug it.
